Eminent Domain is an issue that interests or has implications for ALL of us. That much is clear from previous discussions on this board about it. Below is a link to Susette Kelo's testimony to Congress and her experiences in dealing with the "JBT's".

A not so small note here about this issue...........To date no government or state organization has passed ANY EFFECTIVE legislation to combate this gross perversion of the Constitution. Alabama passed an Eminent Domain reform law but it contained a huge loop hole for "blight" which in effect makes the law meaningless and a laughable farce. Virginia and some other states are working on passing similar worthless legislation.

It's way past time to take this country back. The democrats want this type of judge, so we have black robed tyrants running rough shot over the Constitution. Justise Stevens admits and others he look at foreign law in cases they review. Unbelievable. The country sleeps when the economy is good and then calls for more intervention when there is the slightest down tick. I vote for Republicans to turn this around, but even they seem complacent and let the liberals push around their elitist beliefs.

Don't be fooled by the Republicans. They have become liberals of a lessor degree and support Judge John Roberts to be appointed as the Supreme Courts Chief Justice! The OBVIOUS choice in my view for Chief Justice is Associate Supreme Court Justice Antonin Scalia. He is the ONLY justice on the Supreme Court who understands his duty to interpret the Constitution as written by the founding fathers. John Roberts is a strong supporter of the current twisted eminent domain laws and has tried cases as a lawyer in the past for clients intent upon seizing private property. Could we do worse than Roberts......... CERTAINLY......... but just be apprised that he is NO conservative. My feeling is that is would be nearly impossible if not totally impossible for ANY president to get a TRUE Constitutionalist candidate through the congressional approval process.

I had a recent conversation with a local business (Bar & Restaurant) owner who was looking into registering his place on the Historical Location (or whatever its called) list and said that he had given up in this because of "other" reasons. When I questioned him further, he began on an explanation of how these historical place registries are often associated with the UN and other "International" registries which a along with the Eminent Domain (tie in) laws could allow the UN to seize properties in the USA. He cited an example in West Virginina, which I knew nothing of.

Has anyone heard of this?? If it's true....

As a matter of pure law, the US Constitution is a very unique animal.

Every other law is intended, written and interpreted as a living, evolving thing.

The Constitution is the opposite, it was intended to be a steadfast bastion of the ideals & principles of the founding fathers and the society they THEN represented.

The result is today, a mish-mash of convoluted interpretations and amendments that span a remarkable period of time.

Unfortunately, the only real solution is also the only unattainable one, a national plebiscite which renders a clear and decisive national opinion (ie, overwhelmingly clear majority vote) on which is the desired route to take, make the Constitution a more modern document, or leave it as the historical benchmark of America it was intended to be.

Just my opinion from up here looking south over a coffee.

Just an observation, (and please correct me if I’m wrong). If you look at the Supreme Court decision on “Kelo v. New London” it was 5 to 4 in favor of the City on New London. The five justices in favor of the City of New London were all Republicans. The four in favor of Kelo were 2-Democrats and 2-Republicans. Take it for what it’s worth...

Regardless of which political party you are attached to, I don't think anyone is pleased with the supreme court ruling when they actually sit and contemplate having their home taken for a mini-mall. Iowa is also looking at adding a law to curb it's abuse. But I suspect loop holes will be placed in there by special interests with the money to open ears and loosen the pens.

If you really want to make a difference, run for your local office. It's tough to have the law abused when you and fellow like-minded individuals are on the city council.

I'm thinking about running myself due to this very kind of abuse by government I'm seeing. The simple truth is we can sit around and complain on an internet chat board or actual utilize democracy and do something about it. The only thing holding me back right now is my company is in the process of being sold. Kind of tough to run for office if I don't know where I'll be living in 6 months.

I hear ya. In theory I think we would ALL like to think this is the case and we CAN make a difference............reality says otherwise. Been there.....done that.........got the T-shirt, sweat shirt, pants, jacket, and fancy tennis shoes................it doesn't make much if any difference.

Let me give you a bit of information that should shock you but in this day and age is unbelievable the norm:

5 out of 10 Americans believe the sun revolves around the Earth.

The average American has no idea who the vice president or their national elected officials are........ just watch Jay Leno's "Jay Walking" interviews.

This is just a sad few but I think you get the idea.

The sad and tradgic consequences are that these people although not all of them VOTE. That is how people like Barney Frank, Charles Shumer, Diane Feinsien, and Ted Kennedy get elected. These idiots are who cast votes for nominees for the Supreme Court!

Up here in the great white frozen north we have a kind of interesting twist on the smae principle.

Here we call it expropriation, and it is more like a forced SALE, they have to pay market value, and you can easily argue your opinion of the value, and the tribunal listens.

Now the twist, in a recent court ruling they established a new principle. You can use the INTENDED or FINAL use as an arguement for PRESENT value.

In other words, if they say your place is worth $500k as a home on a few acres because of zoning or whatever and it cannot be developed. But if they plan to expropriate to build a mini-mall, which would make the land worth millions, you can use those plans and values to say your place is worth several millions, not hundreds of thousands. If they do not declare their intentions you can even go back after the fact for your top-up money.

This does two things, first it makes the body wishing to take the land think long & hard before trying, and secondly, gives the landowner many times what they could ever have gotten had the government not forced the issue.
